“The British Mountaineering Council recognises that climbing and mountaineering are activities with a danger of injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement,’’
Association of British Climbing Walls - "All climbing activities have a risk of serious injury or death. Participants must recognise that even if they follow all good practice there may still be the risk of accident and injury. It is the responsibility of the participant to adhere to the conditions of use"
1.1 ASSUMPTION & ACKNOWLEDGEMENT OF RISK
I hereby acknowledge and accept that the activity of indoors climbing and associated activities the use of The Peak Climbing School Ltd, trading as The Peak Climbing Wall, for our indoor climbing facility, hereafter referred to as The Peak Climbing Wall, participation in its activities and or observation of such activities, involves risks. I recognise that some risks are inherent and as such cannot be eliminated or reduced. I confirm that I understand the nature and extent of these risks, which can include, but are not limited to:
- All manner of injury resulting from falling from height and coming into contact with; the floor, climbing surface, people and/or other permanent or temporary structures.
- Injuries resulting from the actions or oversight or others, including, but not limited to; falling climbers or dropped items.
- Failure or misuse of equipment or any part of the facilities.
- Failure to follow The Peak Climbing Wall facilities conditions or use and rules as outlined in sections 1.2 and 1.3.
I further acknowledge that there are risks associated with the use of The Peak Climbing Wall facilities and participation in its activities other than climbing-related ones, including, but not limited to, the use of training equipment or participation in group classes.
I confirm that to the best of my knowledge neither I, nor any person(s) I am signing on behalf of, suffer from a medical condition that could increase the risk that I, or they, will be involved in an accident which could result in injury to myself. them or others.
1.2 CONDITIONS OF USE
Our Duty of Care - The rules set out in section 1.3 are not intended to limit your enjoyment of the facilities. They are part of the duty of care that we as operators, owe to you our customers, by law. As such they are not negotiable. If you are not prepared to abide by them you may not use our facilities. Should it come to our attention that you are not abiding by our rules you may be asked to leave.
Your Duty of Care - You also have a duty of care to act responsibly towards other users and to adhere to our rules. Statements to 'Best Practice' are posted around the centre adjacent to the relevant facilities. These describe the accepted methods of use and how customers would normally be expected to behave towards each other.
Unsupervised Climbing - Before you engage in any climbing activity without supervision, we expect you to be competent in the activity you wish to undertake. By registering that you (person signing this document) understand and accept the risks and agree to abide by the 'Conditions of Use' and 'The Rules' involved in your participation.
Staff will provide whatever help and advice they can, but formal instruction in the use of equipment will only be provided when booked and paid for. Should you not be competent in the use of any of the equipment, you must not attempt to use it without the supervision or someone who Is competent and signed of to that effect.
Supervised Climbing - An adult (defined as a person over the age of 18 years of age) who has registered for 'Unsupervised Climbing' may supervise up to two novices, if they are prepared to take full responsibility for the safety and wellbeing of those novices. Groups of three or more novices must only be supervised by an instructor holding relevant qualifications and insurance, and who has registered as an ‘Instructor' at The Peak Climbing Wall. Novices must remain with their supervisor at all times whilst within climbing areas. When engaged in supervision, a supervisor must not leave the ground at any point.
Under 18's - All under 18's must be supervised by an adult deemed competent in the activity they are engaging in, unless they have been registered and assessed by centre staff to engage in 'Unsupervised Climbing'.
1.3 THE RULES
General Safety
Check in at reception upon each visit before engaging in any activity. Exercise due care, common sense, and self-preservation at all times. Report any problems with the walls, equipment or other climbers' behaviour to a member of staff immediately.
Be aware of other climbers and how your actions could affect them.
Never stand or climb directly under someone who is climbing.
Stand well back from the climbing walls unless supervising a climber.
Avoid distracting others while they are climbing or supervising.
Please be aware that impact flooring does not remove the risk of injury but is designed to reduce the severity of these injuries.
Ensure the climbing area and your persons are free from hazardous items.
Refer to best practice signage for specific area safety rules.
Be aware of the emergency exits and fire assembly points.
Understand holds may spin and can cause falling as a result. You must report the hold to a member of staff at reception immediately.
Bouldering
Never climb directly above or below another climber. Always ensure you are in a position to descend safely.
Descend by down climbing. Should that not be possible, then at the very least use a controlled fall.
Ensure a safe landing zone before descending.
Do not leave equipment, bags, bottles, etc on the bouldering mats.
Grabbing the tops of the climbing wall surfaces is prohibited.
Do not climb on any of the roof beams or trusses.
Training area
Customers agree to use any equipment provided by The Peak Climbing Wall at their own risk, the equipment is strictly for customers 18 years old and above
Customers are responsible for keeping the kit in a safe and tidy manner

1.4 RELEASE OF LIABILITY
My participation, and that of any person(s) I am signing on behalf of, is purely voluntary, and I or they, elect to participate despite the risks
I hereby voluntarily release, forever discharge, and agree to hold harmless The Peak Climbing Wall, its owners and employees, with respect to all losses, damages, claims or other liabilities, whether known or unknown, arising out or any property damage, personal injury or wrongful death in any way connected to my participation, and that or any person(s) I am signing on behalf or, in activities both indoors and outdoors, that are hosted by or involve The Peak Climbing Wall, its facilities or employees, with the exception of gross negligence or intentional misconduct.
I authorise The Peak Climbing Wall employees to provide or obtain medical care without liability, for me or any person(s) I am signing on behalf of, and if required, to arrange transport for me or them to a medical facility.
I confirm that The Peak Climbing Wall may use any photograph or video of me or any person(s) I am signing on behalf of taken inside their facility or at an activity hosted by them for promotional purposes related solely to the advertisement of their business. To opt out of this photography and video release of liability, please cease completing this agreement and email info@peakclimbingwall.co.uk.

Privacy and General Data Protection Regulations (GDPR) Policy:
To comply with GDPR we are required to obtain your consent to collect and store your personal data. The Peak Climbing Wall is the Data Controller. We require your data to ensure that you comply with the conditions of use of the centre. We will store your data securely and will not disclose it to any third party. At any time you can request a copy of your data free of charge. GDPR makes provision for you to request to have your data removed and erased. This is known as the ‘Right to erasure/ right to be forgotten’. When data is held for the establishment, exercise or defence of legal claims we have the right to refuse to erase the data. For this reason our insurers insist that we continue to hold your data for 3 years from the date of your most recent visit.
In order to be allowed to use the facilities and services provided by The Peak Climbing Wall you are required to consent to our Privacy and GDPR Policy. Please click here to give your consent
2.0 PRE BOOKED SESSIONS
2.1 - All bookings must be reserved online, via email, telephone, or at reception.
2.2 - In the case of a deposit being taken, full payment must be made 7 days prior to the session start date.
2.3 - In the event that the booking fee is not paid in full, The Peak Climbing Wall has the right to refuse you to participate on the course or event.
2.4 - Any booking amendments must be made in writing and will be subject to our cancellation policy.
2.5 - Amendments are only permitted subject to availability and at the discretion of The Peak Climbing Wall.
3.0 Cancellations:
3.1 - Cancellations must be made in writing via email or letter, or verbally via telephone or at reception
3.2 - If you cancel your booking within 48 hours of your session start time, you will not be entitled to any refund or credit.
3.3 - If you cancel outside of the 48 hours prior to your session starting, you will be given the opportunity to either re-book onto any other session running at a later date; given credit to be used in our shop or any other future sessions.
3.4 - In the event of a cancelation by The Peak Climbing Wall due to forces outside of The Peak Climbing Walls control customers will be offered the following:
Chance to re-book onto another course of your choice.
Credit to be used on any future courses or shop purchases.
3.5 - If The Peak Climbing Wall cancels a session because of factors within our reasonable control, we will offer a full refund.
